Copyright and DMCA policy

CartBooker.com LLC (“CartBooker”) respects the intellectual property of others and expects the operators and guests who use this site to do the same. This page explains how to tell us about material you believe infringes your copyright, what happens next, and how a user whose material was removed can respond. It is our notice-and-takedown procedure under the Digital Millennium Copyright Act, 17 U.S.C. § 512.

Designated copyright agent

Send copyright notices and counter-notices to our designated agent. The same agent is registered with the United States Copyright Office DMCA Designated Agent Directory.

Email is the fastest route and is what we act on first. Notices sent to any other address, form, or social account may not be processed.

How to send a notice of claimed infringement

To be effective under the DMCA, your written notice must include all of the following:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed.
2. Identification of the copyrighted work you claim has been infringed, or, if multiple works are covered by one notice, a representative list of those works.
3. Identification of the material you claim is infringing and that you want removed or disabled, with enough information for us to find it. On CartBooker that means the full URL of the listing, operator page, article, or image.
4. Your name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees. If you are not sure whether a use is infringing, consider getting legal advice before sending a notice.

What we do when we receive a valid notice

• We remove or disable access to the identified material promptly.
• We notify the user who posted it (for example the operator whose listing photo or description is affected) and give them a copy of the notice.
• We record the notice against that user's account for the purposes of our repeat-infringer policy.

Where the material was supplied to us by a distribution partner rather than a CartBooker user, we also forward the notice to that partner.

Counter-notice

If material you posted was removed or disabled and you believe that was a mistake or a misidentification, you may send our designated agent a written counter-notice containing:

1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location where it appeared before removal.
3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are outside the United States, for any judicial district in which CartBooker may be found), and that you will accept service of process from the person who provided the original notice or an agent of that person.

On receiving a valid counter-notice we send a copy to the original complainant. Unless they tell us within ten business days that they have filed a court action seeking to restrain the alleged infringement, we may restore the material between ten and fourteen business days after receiving the counter-notice.

Repeat-infringer policy

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. In practice: a user who is the subject of two or more valid, uncontested notices within any twelve-month period, or who we otherwise determine has repeatedly infringed, loses their operator or guest account and any listings attached to it. We may also act sooner where the infringement is flagrant. Accounts terminated under this policy may not be re-opened under another name.
