Operator Agreement

Effective date: August 11, 2026

This Operator Agreement (the “Agreement”) governs rental operators (“Operator,” “you”) who list golf carts or low-speed vehicles (LSVs) on the CartBooker.com booking marketplace, operated by CartBooker.com LLC (“CartBooker,” the “Platform,” “we,” “us”). In plain terms: we send you bookings; the rentals — the vehicles, the safety, the insurance, the legal compliance, and the customers — are yours. By accepting this Agreement during onboarding, or by listing or accepting bookings on the Platform, you agree to everything below. If you have signed the Operator Agreement provided during document onboarding, the signed agreement controls wherever the two differ; this page is the standing version for operators who have not yet signed. This Agreement supplements our Terms of Service, which also apply to you.

1. Independent contractor — no agency, employment, or partnership

You are an independent contractor and an independent business. Nothing in this Agreement or your use of the Platform creates an employment, agency, partnership, joint-venture, or franchise relationship between you and CartBooker. You have no authority to act for us, bind us, or make promises on our behalf, and you will not represent otherwise. Each rental booked through the Platform is a contract directly between you and the renter; CartBooker is an intermediary and technology provider only and is not a party to any rental.

2. Your right to rent the listed vehicles

You represent and warrant that you own, or otherwise hold all rights and permissions necessary to rent out, every vehicle you list; that your business is duly formed and in good standing where required; and that all information you provide to the Platform and to renters — listings, photos, pricing, availability, policies — is accurate, current, and not misleading.

3. Vehicle safety, maintenance & registration

You are solely responsible for your vehicles. You agree to:

  • keep every listed vehicle in a safe, roadworthy, and well-maintained condition, inspected and serviced per manufacturer guidance and prudent industry practice;
  • ensure every vehicle is registered, titled, insured, and street-legal to the extent applicable law requires for how it will be used (including LSV requirements such as VINs, lights, mirrors, seatbelts, and license plates where applicable);
  • remove a vehicle from service immediately if it develops a condition that could make it unsafe;
  • provide renters with accurate operating instructions and all safety equipment required by law.

4. Insurance

You must maintain, at your own expense, the insurance your rental business is required to carry under applicable law (including motor-vehicle coverage such as PIP/PDL on registered LSVs) and commercially reasonable liability coverage for renting vehicles to the public. Our Insurance Guidance sheet describes the coverage most operators carry and what we recommend. CartBooker does not provide insurance of any kind for you, your vehicles, or your renters, and listing on the Platform is not a substitute for your own coverage. If we ask, you will provide a current certificate of insurance within a reasonable time. You will notify us promptly of any accident, injury, theft, or insurance claim involving a vehicle rented through the Platform.

5. Legal compliance, licensing & taxes

You are solely responsible for complying with all laws that apply to your business and rentals, including: business licensing and permits; local and state golf-cart/LSV rules; consumer-protection, safety, and signage requirements; age and driver's-license requirements for renters; and the collection, remittance, and reporting of all applicable taxes (sales, tourism/surtax, income, and otherwise) on your rentals and payouts. CartBooker does not provide legal or tax advice and is not responsible for your compliance.

6. Your rental agreement & liability waiver

You must present each renter with your own rental agreement and liability waiver — covering at minimum driver eligibility (21+ with a valid driver's license), safe and lawful operation, assumption of risk, damage responsibility, and your deposit and refund terms — and obtain the renter's signature or affirmative acceptance before releasing a vehicle. That agreement is between you and the renter; CartBooker is not a party to it, and you will not name the Platform as a provider or guarantor in it.

7. Bookings, cancellations, refunds & renter disputes

You are responsible for honoring confirmed bookings and for the entire rental experience: delivery or pickup, driver eligibility and licence checks, instructions, support during the rental, and return. You set your own prices and your own cancellation policy, and we display them to renters as yours. You are responsible for your own cancellations, rental refunds, deposit claims, and disputes with renters, including payment-processor chargebacks attributable to your rentals. CartBooker may, at its discretion, assist with a dispute but has no obligation to do so and no liability for the outcome.

You will honor the cancellation policy shown on your listings. If you cancel a confirmed booking, the renter gets back everything they paid online — a prepaid rental is refunded from your account, and any reservation deposit we collected on your behalf is refunded by us — and we may remove your listings. Repeated cancellations, no-shows, or listing availability you cannot honor are grounds for suspension under §11.

8. Renters pay your listed price. You pay a 10% commission on bookings we deliver.

Listing on CartBooker.com is free. Our compensation is a flat commission of 10% of the rental subtotal, and it applies only to bookings that originate on CartBooker.com. Walk-ins, phone bookings, bookings from your own website, and bookings you record manually in the dashboard carry no commission — ever. The commission is calculated on the rental subtotal only: delivery charges and your pass-through fees are excluded. The renter pays your listed price; we add no fee on top of it.

Prepaid bookings. A connected, charges-enabled payment account (Stripe) is required to take prepaid bookings: your listings can be displayed, but cannot be booked on the prepaid track, until it is live. The renter pays the full listed price at checkout and that charge is created on your own account. You are the merchant of record: your name on the renter's statement, your funds, your refunds, and chargebacks are debited from your balance, not ours. Our 10% commission is deducted from that transaction automatically, as a platform fee, when the payment is captured. On a request-to-book, the renter's card is authorized at the request and captured only when you accept; a decline or an expired request releases the hold, and no commission arises on a payment that is never captured. You manage refunds and disputes from your own payment dashboard — we cannot issue them for you. CartBooker never holds a prepaid rental payment, never forwards it, and is never the merchant of record for it.

Deposit bookings (where the reservation-deposit option is enabled for your account). The renter pays 10% of the rental subtotal online as a reservation deposit, which we collect on your behalf; it counts toward the rental total, and you collect the balance directly at delivery. When the rental completes, we retain that deposit as our commission — it is the entire commission on the booking, and we never invoice you. If the renter cancels inside your cancellation window or fails to show, the deposit is forfeited to you under your policy: we forward it to you in full and earn nothing on a cancelled deposit booking. Forfeited deposits are released to you after a 14-day dispute window (renter disputes run through our support). You authorize us to recover a forwarded deposit — by offset against amounts otherwise payable to you, or by repayment — if a payment dispute on that deposit is later lost.

Card processing fees are separate and are not ours. On a prepaid booking the charge is made on your own payment account, so your payment processor deducts its fee from your side — exactly as it would on your own website. The math on a $360 rental: the renter pays $360, with nothing added on top; our $36 commission (10% of the subtotal) comes out of your side of that charge; and your processor's percentage applies to the $360 the renter actually paid.

Bookings made before this commission model took effect keep the arrangement shown when they were made — including any renter-side booking fee we charged on them, and, on the oldest bookings, the renter paying you the rental in person at delivery (which remains yours to collect). We charge no commission on those bookings.

Because you are the provider and seller of the rental, you are solely responsible for collecting and remitting any sales, use, rental, surcharge, or tourist-development tax on the rental, for your own tax reporting, and for your own payment processing and any chargebacks arising from it. We may change the commission rate only prospectively and with notice; a change never applies to bookings already made.

We have not certified as a Florida marketplace provider. Florida law provides that where a marketplace provider is required to collect tax it certifies as much to its sellers, and the seller then stops collecting on those sales. CartBooker has made no such certification, and nothing on this site or in any message from us should be read as one — so you remain the collecting party. If the Florida Department of Revenue determines the obligation is ours, we will tell you promptly and change this.

Two practical requirements follow, both set out in the signed Operator Agreement: keep your Florida sales tax registration (and rental-car surcharge registration if you rent registered LSVs) current and on file with us, and provide quarterly evidence that you filed and paid. That evidence protects you as much as us — Florida cannot collect the same tax twice on one sale, so proof that you remitted it is the answer to any later question about who owed it. Listings can be paused while it is outstanding.

9. Indemnification & hold harmless

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless CartBooker.com LLC and its owners, officers, employees, contractors, and affiliates from and against any and all claims, demands, damages, losses, liabilities, fines, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your vehicles, including their condition, safety, maintenance, registration, or legality; (b) any rental, including any accident, bodily injury, death, property damage, or theft; (c) your acts or omissions or those of your staff or agents; (d) your breach of this Agreement or violation of law; (e) your failure to maintain required insurance; (f) your tax obligations; or (g) any dispute between you and a renter or other third party.

10. Platform disclaimers & limitation of liability

The Platform is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee any volume of bookings, leads, or revenue, or that the Platform will be uninterrupted or error-free. To the fullest extent permitted by law, we are not liable to you for indirect, incidental, special, consequential, exemplary, or punitive damages or lost profits, and our total aggregate liability to you for any and all claims relating to the Platform will not exceed the platform fees and commissions CartBooker actually earned from your bookings in the three (3) months before the event giving rise to the claim. Nothing here limits liability that cannot be limited under applicable law.

11. Suspension & removal

CartBooker may suspend or remove your listings or your account at any time, at its sole discretion — including for safety concerns, renter complaints, suspected fraud, lapsed insurance, legal-compliance issues, or breach of this Agreement — with or without notice. You may stop listing at any time. Confirmed bookings outstanding at suspension or exit must still be honored or lawfully wound down, and Sections 1, 2, and 5 through 10 survive termination of this Agreement.

12. Acceptance & records

You accept this Agreement by checking the acceptance box during operator onboarding (we record the date and time of acceptance) or by listing or accepting bookings on the Platform. We may update this Agreement from time to time; the effective date above reflects the current version, and continued use of the Platform after an update constitutes acceptance. If any provision is held unenforceable, the rest remains in full force.

13. Governing law & contact

This Agreement is governed by the laws of the State of Florida, without regard to conflict-of-laws rules, with venue in the state or federal courts located in Sarasota County, Florida. Questions? Email support@cartbooker.com. See also our Terms of Service and Privacy Policy.
